9. Returns – Right of Withdrawal for Goods

Consumers have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days from the day on which you, or a third party other than the carrier indicated by you, acquired physical possession of the last of the goods.

LAS VELAS DE MARIANO informs you that you have the right of withdrawal without giving any reason, provided that the products purchased do not fall within the categories set out in Article 45 of the Retail Trade Regulation Act. You may exercise this right under the following conditions:

LAS VELAS DE MARIANO accepts all returns made within the stated period, following an individual assessment of the condition of the product upon receipt.

LAS VELAS DE MARIANO accepts the return provided that the customer bears the cost of transport.

The liability of LAS VELAS DE MARIANO is limited to this replacement.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

LAS VELAS DE MARIANO will check the condition of the product before proceeding with the refund of the amount.

In the event of withdrawal on your part, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs arising from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and, in any event, not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us without undue delay and, in any event, not later than 15 calendar days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 15 calendar days has expired. You will have to bear the direct cost of returning the goods.

You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

10. Delivery of Damaged Orders

In the event that the order is delivered with visible damage (such as breakages, impacts or obvious defects in the products), the customer has a maximum period of five (5) working days from receipt of the order to report the incident to LAS VELAS DE MARIANO, S.L.

The notification must be made in writing via e-mail to hola@lasvelasdemariano.com, stating the order number and including clear images that allow the defective condition of the product to be verified.

After this period has elapsed, LAS VELAS DE MARIANO, S.L. shall not assume any liability for damage that the products may have sustained, except in cases provided for by law.

Once the claim has been validated, the company will handle the incident in one of the following ways, depending on the nature of the damage and product availability:

Issuance of a voucher or discount code for the value of the damaged item, redeemable on future purchases.

Refund of the amount corresponding to the damaged product.

Replacement of the product with a new one, with LAS VELAS DE MARIANO, S.L. bearing the shipping costs of the new delivery.

16. Order Claims

If, once the estimated delivery period has elapsed, the customer has not received their order, they must contact LAS VELAS DE MARIANO, S.L. through the available channels. The company will carry out the corresponding tracking with the courier and will provide the customer, as soon as possible, with updated information on the status of the shipment.

In the event that the delay is attributable to the courier, LAS VELAS DE MARIANO, S.L. shall not assume liability arising from such delay. As a compensatory measure, the company may offer the customer a commercial discount on future purchases. However, under no circumstances will shipping costs already paid be refunded.

17. Minors

We do not sell products to minors. The products we sell must be purchased by adults. Persons under the age of 18 may only use Las Velas de Mariano products under the supervision of a parent or guardian.

18. Conformity Guarantee

As a consumer, in the case of the sale of goods, you should be aware that our products carry a guarantee for any lack of conformity that exists at the time of delivery of the product and that becomes apparent within a period of three years from delivery.
